Report: $27 million Madden payout to customers stalled in Appeals court

Report $27 million Madden customer payout on hold in Appeals courtIn 2008, a lawsuit alleged EA violated antitrust laws by holding exclusive licenses with the NFL, NCAA and AFL, and in 2012, EA admitted no wrongdoing and settled for $27 million. That money was, in part, to be distributed among people who bought Madden NFL, NCAA Football or Arena Football games for Xbox, Xbox 360, PlayStation 2, PlayStation 3, GameCube or Wii between January 1, 2005, and June 21, 2012. Those applicable could fill out an online form to claim their damages, and in April the form deadline was extended because so few people applied; individual payouts tripled from the initial estimate.

Now, people who followed the case and filled out the form have to wait to receive their payout, following an objection from an invested person named Aaron Miller, Kotaku reports. Miller objects to the size of the attorneys' fees, and while his initial movement was dismissed, his subsequent appeal is in San Francisco's US Court of Appeals for the Ninth District. While the appeal is in process, payouts are on hold.

Miller's brief is due on October 7 and the response to his filing is due one month later, the site says. Payouts will remain in limbo until the end of the year. Stay strong – there's no real "bad time" for free, surprise money.

Report: Square Enix America CEO leaves, joins Amazon

hit 1st Report Square Enix America president is outSquare Enix America CEO Mike Fischer left the company this month and is now vice president of digital music and video for Amazon in Japan, Polygon reports. This follows news in April that Square Enix America eliminated "a number of positions" and Fischer was expected to leave in May. Those same reports said the head of marketing should be gone after E3, along with other employees in public relations.

In March, Square Enix President Yoichi Wada stepped down and the company announced widespread restructuring that it expected to cost $106 million. Square Enix posted a net loss of $134 million for fiscal year 2013, citing "weak" sales of major console games, including Sleeping Dogs, Hitman: Absolution and Tomb Raider, the last of which sold 3.4 million in its first month.

Report: THQ's WWE license going to Take-Two

While most of THQ's coffers have already been cleaned out, there's been no official word on any party making a move on the WWE license. An IGN source suggests Take-Two will take over the WWE line of games.

The negotiations for the WWE license apparently took place outside of the formal THQ auction, IGN notes. According to documents obtained by Joystiq, Take-Two has already spent $10.9 million snagging Turtle Rock's Evolve from THQ.

Rumours regarding next-generation consoles are about a dime-a-dozen these days, but IGN usually seems to have their hand on the pulse of the industry perhaps better than anyone else, and they have some pretty juicy info regarding Microsoft's next home console.

According to IGN's "sources close to the project", the next-gen Xbox console is slated to launch in late October or early November of 2013, and will feature a graphics card derived from AMD's 6000 series of GPUs, more specifically the Radeon HD 6670. While that might not seem particularly impressive given that the average gaming PC already features significantly more potent cards and AMD's 7000 series of cards will be hitting the market in the next year or so, it is a huge leap for dedicated gaming consoles. In fact, it is said to have six times the graphics processing power of the Xbox 360, and 20% greater performance than Nintendo's forthcoming Wii U. Not surprisingly, the card will also support DirectX11 along with 3D and 1080p HD output.

Developers will allegedly be receiving development kits based on the console's final specs this summer, and mass production of the GPU will begin by the end of this year. We're unlikely to receive confirmation from Microsoft until E3 at the earliest, so until then feel free to take this information with a grain of salt, though it seems to be fairly grounded.

Why, for their 'next generation' console, do they choose to use a part that was mid-range over 2 years ago?

Sure, it'll be a bump up from the ancient hardware in the 360, but why not at least use current technology in a console that won't be out for at least a year...

I guess it's up to Sony to fix things. But since they're the ones that took the risks last time (and nearly ended up losing out) I don't know if they'll go for their standard high ticket launch.

If they don't put current hardware in at the start then (even from a _marketing_ perspective!) they're shooting themselves in the foot. The current GPUs are way more than just for graphics now. They allow much more advanced AI, hardware accelerated physics as well as all the cool visual stuff.

Perspective. The current Xbox hardware can't handle running any visually complex game at native 1080p (Hell, it fails to do it at 720p on some games) This 'new' GPU is approximately 6x as powerful. Without taking into account optimisations and improvements and just running on their '6x' number (of which there have admittedly been quite a few between the two) Running a current generation game at a proper 1080p60 resolution would only leave a limited amount of room for improvement.

Sure, full resolution will be nice, but it might almost be too subtle for Average Joe CoD player to notice. Skimping on the graphics hardware not only limits the initial impressiveness, but also the increase in visuals people have come to expect over the life of a console.

tl;dr - they're cheaping out and it might backfire

It does seem a bit underpowered for a console that should probably last until 2018 or so. I am no expert on the subject but doesn't a dedicated games console make far better use of the GPU than a PC though? I mean the Xbox 360 chip is incredibly outdated in PC terms but it still delivers some very impressive looking games. Plus a high-end card goes for what, $500+? Not very cost effective for a console.

I dunno "6x" doesn't really mean much to me until I can see what it looks like.

^I give a toss about power.

Also sounds pretty interesting that would only be 20% more powerful than the Wii U. Sounds like an Xbox vs. PS2 comparison, I think most people would have thought the Xbox 720 or whatever it will be called would be quite a leap technologically over the Wii U but it sounds like they could be comparable.

If the no used games thing is true I can see a few places not wanting to stock it (think back with the PSP go, some places didnt want it)
Used games is where stores make there money

Few people I know buy games on release day any more as main console Mario/Zelda games aside almost all of them see a price decrease a few weeks later

Look at the likes of Deus EX HR
Seen it about now for a tenner new

It seems we will be playing this game for a while yet. All kinds of rumours and speculation have been rampant since last year's E3 regarding when the next-generation Xbox and the PlayStation 4 will be revealed now that Nintendo has unveiled the Wii U. A more credible source has recently stepped forward though, as UK gaming website MCV claims to have some high-level sources that are confirming that both the next Xbox and the PS4 will be at E3 2012 in some capacity.

"Obviously we can't reveal our sources. But you have my personal word on this - the source is exemplary, 100% concrete, ultra high level," stated MCV online editor Ben Parfitt via Twitter.

It's unlikely, if the report is true, that either console will have a particularly significant presence at this year's E3, given that neither is expected to be launched until late-2013 at the earliest. But no doubt their mere announcement along with a handful of details would take a hefty chunk of swagger out of Nintendo's stride as they reveal final launch details and games for the Wii U at this year's E3. As always, such reports are to be taken with a grain of salt until confirmed, but E3 2012 could be shaping up to be one of the most significant shows in the event's history.

The PS4 might not be at 2012, fair enough - but I wouldn't 100% rule it out. Sony do not want to launch 2 years after the Wii-U and 1 year after the Xbox, they don't want to play catch up again.

I doubt we'll even see that - third party games will be the same, Wii-U will probably get less third party games than the other two platforms anyway and then the Wii-U will eventually be behind again. Vicious cycle and all that.

Report: EA shuts down Bright Light after consultation process

EA's Bright Light Studio in the UK has been officially shuttered, Develop reports. In October Bright Light was in the midst of a formal consultation process, a period of time required by UK law before a company can shut down completely, dependent on how many employees it has. Bright Light, responsible for three of the most recent Harry Potter games, closed late in 2010, Develop says.

EA said previously that it would consider Bright Light employees for positions at other EA Studios, and Develop reports some have indeed moved to EA's Criterion and Playfish, while others have joined nearby studios Jagex and Supermassive Games.

We have contacted EA for confirmation on the closure.

Report: Activision scoops up blackops2.com

Activision, by proxy, has bought BlackOps2.com. Fusible did the detective work on this, which posits Activision bought up Black Ops domains last year -- up to Black Ops 6 -- through brand protection company MarkMonitor. Black Ops 2 domains were missing from the previous list, but it appears that's being rectified.

Now, none of this guarantees that Black Ops 2 is on the way as this year's Call of Duty, but it does mean that MarkMonitor is under orders to protect the brand for the future.

Call of Duty: Black Ops had a record-breaking debut of $650 million in sales during its first week at retail in 2010, which it held for one year until Call of Duty: Modern Warfare 3 crushed that with $775 million.

Report: Crysis 2 is the most pirated game of 2011

Who pillaged the most booty in 2011? Which vessel had the most ornate mast? ... Wait, we've got it all wrong -- these aren't the pirate pirate awards for 2011, they're the most pirated games of the year. Can you guess which game took top ... um ... "honors?"

TorrentFreak has tossed out some estimate figures, saying that Crysis 2 was downloaded 3.9 million times over BitTorrent since March, edging out Modern Warfare 3, which was downloaded an estimated 3.6 million times since November. Taking third place on its list was Battlefield 3 with an estimated 3.5 million downloads. Rounding out the top five on the PC side were FIFA 12 and Portal 2.

There are also estimated figures for Xbox 360 and Wii games -- Gears of War 3 and Super Mario Galaxy 2 were the most pirated games with 890,000 and 1.2 million estimated downloads, respectively.

1UP is reporting today that developer Silicon Knights is currently facing "massive layoffs" that will see all but 25 employees laid off from the 97-person studio, according to "sources close to the company". The developer, perhaps best known for its work on GameCube games Eternal Darkness: Sanity's Requiem and Metal Gear Solid: The Twin Snakes, has struggled since parting ways with Nintendo in 2004 having since released the critical and commercial disappointment Too Human on Xbox 360 and the even more poorly-received X-Men: Destiny which was released just a month ago.

Surprisingly, the move would follow several grants made to the company in recent years, including a $4 million grant from the Canadian government in 2010 and $3 million contribution from the Ontario provincial government earlier this year, along with $1 million committed from the Ontario Media Development Corporation in 2008. President Denis Dyack had only recently stated that these funds would enable the developer to hire 80 new employees in addition to the 97 current staff, as well make Silicon Knights a self-publishing developer.

Silicon Knights has not yet commented on the alleged layoffs.

In addition to the studio's poor track record on recent games, the company has also been mired in a legal dispute with Epic Games since 2007 in which Silicon Knights has sued Epic on allegations that they received insufficient support for Epic's Unreal Engine 3, the engine on which Too Human was initially being developed on. Epic has a counter-claim alleging that Silicon Knights tried to use the engine as it pleased without paying anything for it.

UPDATE: Silicon Knights has confirmed that 45 employees have been laid off, leaving around 40 staff still working at the studio. CFO Mike Mays pointed to a project that was recently axed by Activision as the reason for the layoffs, but hopes that the developer will be able to re-hire staff if and when work can begin on a new project.

Report: French delivery truck hijacked, 6,000 copies of Modern Warfare 3 stolen

A delivery truck in Créteil, France carrying 6,000 copies of Modern Warfare 3 was hijacked and stolen on Saturday by two masked people, French news outlets TFI and Ultimate PS3 reported. The truck crashed with a car, and when the truck's drivers exited, two people in masks tear-gassed them before taking off with the games, TFI said. The shipment was reported to be worth 400,000 euros ($551,000).

If you're in the Créteil area and happen to see two people in a delivery truck grinning like maniacs and most likely high-fiving a lot, you may want to contact the authorities. And everyone -- let's settle down. Modern Warfare 3 comes out on Tuesday. It's not worth jail time to play this one a few hours early.

Report: Used and digital sales make up 35% of total console spending in the US

American gamers buy more used and digitally distributed games than their European doppelgangers, according to a study released by market analysis firm NewZoo. The organization's statistical findings show that 23 percent of console games purchased in the U.S. are used; slightly more than the European market where used games account for 20 percent of total console sales.

Digitally distributed titles rank lower in both regions, taking up 12 percent of the console market in America and 9 percent in Europe. That 12 percent, by the way, represents approximately $960 million, on account of 54 percent of American console owners reportedly spending an average of $49 a year on console downloads.

American PC gaming culture appears to have adopted the idea of digital distribution much faster than the console market, as an estimated 58 percent of all PC gaming dollars are spent on digitally distributed games or DLC. Now, we're no market analysts, but we think the disparity between PC and console download shares has a lot to do with PC gaming's readily available plethora of hats.

Following months of speculation, it appears the inevitable is about to come to fruition as Eurogamer is reporting that an announcement from Gearbox Software and 2K Games regarding a sequel to its surprise 2009 hit shooter Borderlands is imminent. According to the source, the game will launch sometime in 2012 for PC, Xbox 360, and PlayStation 3.

Borderlands impressed critics in 2009 with its impressive visual flair and unique RPG mechanics, garnering an 85.9% average rating on GameRankings (Xbox 360 version). Perhaps even more impressive, the game managed to strike a chord with gamers en masse to the tune of over 4 million copies sold, prompting publisher 2K Games to describe a sequel as "a no-brainer".

Report: Kirby Wii officially named 'Kirby Returns to Dreamland'

After waking up just in time to briefly appear at Nintendo's E3 2011 press conference, Kirby will apparently be heading back to Dreamland in his forthcoming Wii appearance. In speaking with a Nintendo rep at this week's San Diego Comic Con, Siliconera heard that the none-too-subtly-named Kirby Wii will actually be named "Kirby Returns to Dreamland" when it arrives this fall.

Nintendo has yet to confirm the title, but we expect we'll hear official word when the company decides to make a big release date announcement. And given how much we liked the game when we played it back at E3, here's hoping that announcement comes soon.

Report: Zynga offered $1 billion cash to acquire PopCap

Forbes reports that Zynga once had its eyes on PopCap Games, and offered $1 billion in cash for the company. The Forbes source says that the company would have funded the deal with a line of credit from Goldman Sachs, one of the underwriters of the 'Ville-maker's IPO.

The Forbes report reiterates some of the details from a TechCrunch report in June, which noted that China-based Tencent (which owns League of Legends dev Riot Games) was also in the mix.

In the end, PopCap Games was acquired by Electronic Arts, for $750 million and another $550 million in performance payouts.

NPD report: 'Digital gamers' encroaching on 'Core gamer' turf

According to a new report from NPD, digital gaming (i.e. "not retail" gaming) is on the rise, with "digital gamers" gaining headway against "core gamers" in two categories. Specifically, digital gamers spend sixteen hours gaming per week, as compared to the eighteen hours spent by the core. Digital gamers actually purchase more games, pulling in 5.9 games over the last three months, while their core brethren brought home 5.4 in the same period. Meanwhile, both groups are actually hefty acquirers of downloadable games, with downloadable titles accounting for more than a third of overall game purchases.

The question, then, is what exactly separates the two demographics? After all, it looks like they share fairly similar habits, according to the numbers. We turned to NPD's David Riley, who explained that core gamers as defined by NPD are "very engaged across all systems, especially consoles" and have "higher use of Xbox 360 and PS3 than all other segments." When it comes to digital purchases, core gamers are more likely to buy add-on content than full games.

Digital gamers, on the other hand, "are engaged in a variety of gaming, from PC to mobile, console to portable, online and offline." They also have the "highest number of digital games acquired" and particularly enjoy the immediacy of downloadable purchases.

Still, it's clear that there's some crossover between demographics, something that seems to be recognized by NPD itself. Citing the growth of mobile and tablet gaming, NPD's Anita Frazier notes, "what a game is and what it means to be a gamer is evolving, reflecting the rapid nature of change within the industry."
DIGITAL GAMERS CLOSING ON CORE GAMERS
FOR TOP GAMER SEGMENT

Port Washington, NY, June 27, 2011 - According to Gamer Segmentation 2011: The New Faces of Gamers, the latest report from leading market research company The NPD Group, Core Gamers, once considered to be the leading gaming segment within the video game industry, is facing rising competition from Digital Gamers for amount of time spent gaming and number of games acquired.

At 18 hours per week, Core Gamers still spend the most amount of time gaming, but Digital Gamers are heavy gamers as well, spending 16 hours per week. The average number of games acquired by Core Gamers in the past three months is 5.4 games, while Digital Gamers are the heaviest game acquirers, reporting an average of 5.9 games acquired for any system/device over the same time period.

When looking at the number of digital games downloaded among those who acquired at least one game, it is Digital Gamers and Core Gamers who stand out with the highest number of digital games purchased; for both segments, more than one-third of the total games acquired are digital.

According to the report, Core Gamers represent the highest number of gamers (23 percent), followed by Family+Kid Gamers at 22 percent. Avid PC Gamers and Light PC Gamers both represent 15 percent of gamers, with Mobile Gamers and Digital Gamers trailing.

From consoles and portables to smartphones, digital music players to PCs, today's use of systems and electronic devices for gaming is more diverse than ever before. While there are still certain clear-cut system affinities, most of the gamer segments are playing on at least three systems.

The platforms people use to game on have therefore become somewhat less dominant as a segment driver, with other metrics pushed to the forefront such as hours per week spent gaming, likelihood to acquire and purchase games and digital/physical purchasing behavior.

"The name of the game in 2011 seems to be choice. Gamers are increasingly branching out to methods of play other than those that the industry has traditionally expected them to use," said Anita Frazier, industry analyst, The NPD Group. "Fueled by the growth of smartphones and new tablet devices, mobile gaming continues to accelerate, and what a game is and what it means to be a gamer is evolving, reflecting the rapid nature of change within the industry."

Methodology
The data was collected February-March 2011, and is based on a total of 8,214 respondents ages 2+. Responses for kids under age 13, as well as some kids in the 13-15 age range, were captured through surrogate reporting, where the parent answers on behalf of the child. The data is weighted and representative of the US population ages 2 and older.

Report: Nintendo sold 194,000 3DS units in April and 172,000 Wiis; PS3 sold 204,000

Yesterday, Microsoft was all too willing to toot its own horn and reveal that 297,000 Xbox 360s were sold in the month of April, but GameSpot says it managed to secure numbers for its competitor, Nintendo. The 3DS was apparently just shy of 200,000 units, unloading 194,000 3DS handhelds on consumers.

The Wii lagged behind with 172,000 units sold, while the remaining members of the DS family sold a combined 257,000 units. May should fare better for Nintendo on the Wii side of things, with an impending price cut on the horizon, one that will see consoles bundled with a copy of Mario Kart Wii and a wheel accessory.

As for the PS3, MarketWatch reports 204,000 units were sold -- not bad considering all of the, well, you know. Still, that's not a figure confirmed by Sony, who we've contacted for comment. We'll update you when we hear back.

Report: EA and NFL restructure exclusivity deal amid work stoppage fears

The NFL has cut EA a break, reports SportsBusiness Journal, reducing the Madden maker's licensing fee by an undisclosed amount for the next football season, which remains in jeopardy as the current collective bargaining agreement between the league and the players' union is set to expire March 4 and, so far, renegotiations have been futile. If a new CBA is not drawn between the two sides before the current contract expires, it could result in a work stoppage -- in other words, no football come fall.

While such an outcome wouldn't prevent EA from releasing Madden 12 in early August (the series' traditional launch window leading up to the start of the NFL regular season), it could certainly devalue the expensive NFL-related licenses that EA has secured. Last October, anticipating such a scenario, EA reportedly requested a $30 million dollar discount on its payment owed to the NFL this year. The five-year deal inked in 2008 between the two sides is believed to be worth "well into nine figures" -- that's hundreds of millions -- and is likely the NFL's most lucrative non-TV contract, according to SBJ.

"For one of our core partners in a difficult environment, we say let's look at this, and maybe it makes some sense to extend something out longer and give our partner some relief in the short term, but gain something on the back end," Jacksonville Jaguars owner Wayne Weaver, chairman of the NFL's business ventures committee, told SBJ, alluding to the nature of the restructured deal with EA. According to SBJ's sources, EA has been granted some form of relief for this year's fees, and its NFL exclusivity deal has been extended one year through the 2013-14 football season.

EA maintains a separate, concurrent contract with the NFL Players Association for which the players' union receives $30–40 million, annually (according to the union's Labor Department filings), for the publisher's right to use NFL players in its games. It's as yet unknown if EA has sought to reduce its fees owed to the union this year or extend the deal another year to remain consistent with the companion contract with the league. EA declined our request to comment on its NFL-related licensing agreements for this article.

Report: MTV Games shut down

MCV has reported that MTV Games has officially closed its doors. The site reports that MTV Games' international office was closed on Wednesday and "only a handful of financial staff remain in the New York office to collect or reconcile any outstanding receivables." The news comes in the wake of the recent sale of Rock Band and Dance Central developer Harmonix.

MTV Games parent company Viacom is currently involved in an ongoing legal battle with Harmonix. The developer accuses Viacom of avoiding the payment of performance-based bonuses, a claim that Viacom denies. We've reached out to MTV for comment.
